Arrington 23 April, 1878 Codicil 24 April, 1878 Will Book 25, pages 25-26 Franklin County Courthouse, Rocky Mount, Virginia Transcribed by Beverly (Arrington) Walker, 10 May, 2000, from copies of Franklin County, Virginia, Courthouse records, furnished by Larry Fuda of Rocky Mount, VA. *********************************************************************************** Know all men by these presents that I Charles Arrington of the County of Franklin and state of Virginia being weak in body but of sound and disposing mind and memory, do make and publish this my last Will and Testament hereby revoking all former wills by me at any time heretofore made, and as to my worldly estate, and all the property real or personal or mixed of which I shall die seized and possessed on which I shall be entitled to at the time of my decease I devise, bequeath and dispose of in the names following to witt my will as shall all my just debts and funeral expenses shall by my Executors herein after named, be paid out of my estate as soon after my decease as shall by herebe found covenant, itemised(?) give devise and bequeath to my beloved wife Sarah E Arrington my tract of land on which I now reside together with all its appurtenances, all my household furniture all the property personal and real or mixed to which I shall be entitled at the time of my decease I bequeath it all to her to have and to hold during her widowhood, after widowhood, or after her decease, it is my will that the whole property together with the profits resulting therefrom be jointly and equally divided among my lawful heirs. And lastly I do nominate and appoint my beloved wife Sarah E Arrington to be the Executrix of this my last Will and Testament. In testimony whereof I the said Charles Arrington have to this my last Will and Testament subscribed my name and affixed my seal this 23rd day of April 1878. Charles Arrington (his name and seal) Signed sealed and delivered by the said Charles Arrington in the presence of us who at his request, and in his presence and in the presence of each other, have subscribed our names as witnesses. Witnesses: Buford Wills W. C. Bennett Codicil It is my will that my Executrix named in the above will shall not be required to give security for her executorship of this my last Will and Testament and that this codicil I have affixed my name and seal this 24th day of April 1878. Bennett At a County Court held for Franklin County at the Courthouse on Monday the 3rd day of June 1878 the last Will and Testament of Charles Arrington Deed was produced in Court and proved by the oaths of Buford Wills and W. C. Bennett and also a codicil amixed was proved by the oaths of Buford Wills and W. C. Bennett the subscribing witnesses and admitted to record and on the motion of Sarah E Arrington the Executrix herein named who made oath and executed bond in the penalty of Three hundred dollars without security (the testator requesting shall no surety be required and the Court requiring none) certificate is granted her to obtain a probate of said will in due form.
